GENERAL DESCRIPTION: The Insurance Commissioner is considered the agency head for purposes of final agency action for all areas within the regulatory authority delegated to the Office of Insurance Regulation (Office). The Insurance Commissioner is appointed by, and reports to, the Financial Services Commission (FSC). The FSC is comprised of the Governor, the Attorney General, the Chief Financial Officer, and the Commissioner of Agriculture. The FSC serves as agency head for purposes of rulemaking. The Office was appropriated 292 employees and has a budget of $31.8 million. The Office is responsible for: Licensing insurance companies and insurance-related entities Reviewing forms and rates for insurers and insurance-related entities Monitoring the financial condition of insurers Enforcing compliance with statutory laws and rules The Insurance Commissioner provides senior-level executive, regulatory and policy leadership. Through the Office, the Insurance Commissioner executes and enforces all regulatory responsibilities in furtherance of the public interest. The Insurance Commissioner is responsible for developing internal policies and procedures, the annual legislative budget request and long-range program plan for the Office. The Insurance Commissioner oversees the review of company rate and form filings across regulated lines of insurance and takes appropriate action; monitors the financial strength, solvency and enterprise risk of insurance companies doing business in this state; and ensures that contract provisions keep up with changing legal and market conditions. The Commissioner also advises the Governor, FSC, and Legislature on matters affecting the insurance marketplace, and implements applicable statutory and regulatory policies. Finally, the Commissioner represents the Office before relevant constituencies, both within and outside of the insurance industry and institutions, both nationally and internationally, in a way that benefits Florida consumers and companies. DUTIES AND RESPONSIBILITIES: The duties and responsibilities delegated to the Insurance Commissioner are found in Chapter 20.121(3)(d)1.,F.S. and Chapters 624 through 632, 634, 637, 638, 639, 641, 642, and 651 constituting the “Florida Insurance Code”. Directs the overall operations of the Office of Insurance Regulation (Office) and, through the Office, executes and enforces all regulatory responsibilities under applicable statutes, rules and orders, to promote a competitive market, achieve statutorily appropriate rates, and protect the public interest. The Commissioner is appointed by the Financial Services Commission, composed of the Governor and Cabinet. Responsible for regulating insurance companies and other entities. Executes and enforces all regulatory responsibilities under applicable statutes, rules and orders. Oversees the review of company rate and form filings across regulated lines of insurance and takes action as appropriate. The Commissioner directs the activities of the Office in monitoring the financial strength, solvency, and enterprise risk of insurance companies doing business in this state and their conduct toward insurance consumers. Directs all of the activities of the Office including examinations and investigations, and signs Orders as warranted to address issues identified by examinations, investigations, or otherwise brought to the attention of the Office. The Commissioner also issues bulletins or informational memoranda, press releases, letters, and other documents to inform insurers, consumers, and others of regulatory requirements, announce actions taken by the Office, and to enforce laws governing the business of insurance. Responsible for managing the administrative and budgetary operations of the Office through supervisors responsible for the day-to-day direction, coordination and evaluation of business units. In this capacity, the Commissioner oversees the overall administration of the Office, develops the budget, manages available financial and human resources, and approves operating procedures. Serves at times on committees of state, national and international organizations, including as chair of committees and as an officer or board member of state, national and international organizations. In all of these capacities, the Commissioner is an agent of the State of Florida and working for the benefit of Florida insurance consumers. Serves in the capacity as an officer of and may serve as an account owner for NIMA, Inc., a statutorily-authorized entity managed by the Florida Surplus Lines Service Office to facilitate the collection of surplus lines taxes. Establishes the overall program plans and measures, and strategic goals and objectives, to guide the Office in carrying out its statutorily prescribed responsibilities. Maintains an effective communication system within the Office, and between the Office and the Governor and Cabinet (Financial Services Commission), Legislature, regulated entities, and the public. Manages the responsiveness of the Office to insurance consumers, companies and licensees; and media, policymakers, and others involved in or affected by the business of insurance in this state, and performs other related duties. Five (5) or more years of responsible private sector experience working full-time in areas within the scope of the subject matter jurisdiction of the Office of Insurance Regulation within the last ten (10) years. Five (5) or more years of experience as a senior examiner or other senior employee of a state or federal agency having regulatory responsibilities over insurers or insurance agencies within the last ten (10) years.
